Trina Goethals and Karl Schneider, recently concluded a mortgage fraud conspiracy criminal jury trial in Federal District Court. The Government brought allegations of bank fraud and money laundering, involving short sale transactions and the procurement of mortgage financing where loan proceeds were distributed to borrowers and facilitators in Ohio and Florida.
Trina Goethals successfully represented a Columbus brokerage in its capacity as a property manager. The Plaintiffs made a claim of nuisance due to excess noise and illegal activity allegedly caused by tenants occupying an apartment complex managed by the Defendant brokerage. After the Defendants prevailed on summary judgment in the trial court, Plaintiffs appealed to the Tenth District Court of Appeals. Karl Schneider and Trina Goethals successfully represented a brokerage in a breach of fiduciary duty claim, along with several ancillary issues, in which purchasers of real property sued the brokerage and its agent alleging that latent and patent defects were found for which they were not warned and not properly advised. Additionally, Plaintiffs contented that because the occupants had special needs, additional inspections should have been conducted. Karl Schneider and Mark Meterko successfully represented the purchaser of a foreclosed property at a sheriff’s sale in an appeal of the underlying foreclosure judgment and confirmation of sale before the Tenth District Court of Appeals for the State of Ohio. Mr. Schneider and Mr. Meterko successfully argued that the purchaser should be allowed to intervene in the appeal to protect her interest in the property, and successfully argued for the affirmation of the underlying foreclosure judgment and confirmation of sale.
In September of 2010, Maguire & Schneider was appointed as Special Counsel by former Attorney General Richard Cordray to represent the Secretary of State in the case of Lavin v. Husted, Case No. 1:10-cv-01986 (N.D. Ohio 2010). On behalf of the Secretary, the law firm successfully defended the constitutionality of Ohio Revised Code section 3599.45, which prevents the Attorney General, county prosecutors, and any candidate for Attorney General or county prosecutor from accepting campaign contributions from individuals that provide goods and services under the Medicaid program. Partners Bradley Barbin and Karl Schneider completed a criminal jury trial in March, 2008 involving tax and conspiracy charges in the Eastern District of Pennsylvania Federal District Court. Karl Schneider, along with colleague Trina Goethals completed a civil jury trial in early June, 2008 in the Butler County Common Pleas court involving alleged real estate broker negligence as well as concealment of foundation damage.
